



What is a Torrens title in NSW?
The Torrens Title System is nothing more than a method of possession, in which the Department of Lands of the New South Wales government records and certifies the title of all property in that state:
In order for ownership of land to be transferred or sold, the Land Titles Office requires certain documents to be submitted.
When the Land Titles Office accepts the paperwork and registers you as the owner of the property, only then will you be considered the owner of the property.
The Department of Lands also holds the plan for the neighborhood in which the property is situated. This plan can be viewed there. In this sense, the system is referred to as “Title by Registration,” because the act of registering an area results in the transfer of ownership of that area
Is community title a Torrens title?
When more than one residence is erected on a same block of land, the most common type of title being used these days is called community title, which is something of a hybrid between torens title and strata title. If you buy a house with community title, you will own the structure as well as, in some cases, the land underneath it. On the other hand, the community may own some places and facilities, such as the roadways, the golf course, the grounds, and the club. You will be responsible for contributing to the care and repair of these spaces, just as you would be with Strata Titled homes. While you’ll have the freedom that comes with having your own home and land, there may be local rules that restrict how you can and can’t use your property. This is in spite of the fact that you’ll have ownership of both.
What are the advantages of the Torrens systems?
It provides security against forgery; it helps restore to their fair significance residences kept under good keeper titles but withstood devaluation due to a technical deficiency; and it prevents the recurrence of any faults in the holding of titles over estates that are analogous to the one that caused the original depreciation.
